Mackenzie L. Dimitri, a partner with the firm Einbinder & Dunn, has more than 11 years of experience as a complex commercial and franchise attorney. Ms. Dimitri’s practice is split between litigation and transactional work. On the transactional side, she drafts and negotiates commercial contracts, including franchise and franchise-development agreements, franchise disclosure documents, negotiates business acquisitions, and advises on corporate organizational matters for franchisor and franchisee clients. Her clients span a variety of industries, including fitness, beauty, hospitality, recruiting, transportation, child care, entertainment, restaurant, and real estate.
In addition to her transactional practice, Ms. Dimitri is an experienced litigator, representing clients in trials and other dispute resolution forums throughout the country. Ms. Dimitri has successfully argued for clients in federal courts around the country, and has mediated and otherwise negotiated favorable settlements at various stages of litigation, and has a nuanced understanding of how each client’s business objectives relate to their goals in any given lawsuit.
Ms. Dimitri is an active member of the American Bar Association’s Forum on Franchising, serving on the Women’s Caucus and the Young Lawyer’s Division committee. Ms. Dimitri was asked to publish an article and speak on the topic of equitable relief for the International Franchise Association in May 2020 (which was, unfortunately, cancelled), and will be publishing and speaking on the topic of legal considerations related to social justice issues in brand positioning in May 2021. In October 2017, Ms. Dimitri was asked by her colleagues at the ABA to speak on the topic of efficient breach and equitable remedies in litigation. Ms. Dimitri has hosted webinars, including in March 2017, for the ABA, on regulatory issues for franchisors, and in November 2019, for Lawline.com, on a practitioners’ guide to franchising. Ms. Dimitri presented at the International Franchise Expos in New York and Miami in May 2019 and February 2020. Ms. Dimitri is a regularly contributing ‘blogger’ on E&D’s legal blogs.
