Education.
Mr. Aguilar holds a law degree from Universidad Panamericana (2002-2007).
He completed in 2007 a postgraduate degree in Procedural Law Institutions offered by Universidad Panamericana. He also completed in 2013 a postgraduate degree in Constitutional Lawsuits (“Amparo”), offered by Universidad Panamericana.
In 2016, Mr. Aguilar completed the LLM specialized in Economic Law at Universidad Panamericana.
Main Areas of Practice.
His professional practice has mainly focused on Civil, Commercial, Administrative, Agrarian and Constitutional Litigation. He has participated in cases related to shareholders conflicts, annulment of shareholders´ resolutions, enforcement and execution of agreements, as well as insolvency proceedings. Mr. Aguilar has also participated in proceedings related to ownership and possession of land allegedly subject to agrarian regime.
Among the matters in which he develops his professional activity, are special commercial proceedings (bonds, execution of guarantees, commercial competitions, among others), as well as controversies related to strict liability derived from the occurrence of commercial activities. Likewise, he has participated in litigation related to the ownership and possession of lands allegedly subject to the agrarian property regime, as well as in matters related to territorial limits.
Professional Background.
Mr. Aguilar started his professional practice within the “Pro-bono Law Office of Universidad Panamericana”, where he participated for 5 years, attending to civil and commercial litigation cases. As of August 2008, and until July 2014, Mr. Aguilar joined Barrera, Siqueiros y Torres Landa, S.C., in the civil and commercial litigation area. Currently, he is a founding partner of the law firm Cuellar, Aguilar, Morlett, Isla y Abogados, S.C., today CAMYA Abogados.
Relevant Cases.
Mr. Aguilar has participated in many complex litigation cases related to validity of shareholders’ resolutions regarding civil and commercial corporations. He has represented several foreign financial entities in proceedings related to strict liability from the usage of dangerous mechanisms prevailing in all those cases, achieving in all cases the acquittal of the client. Mr. Aguilar has also represented different national and foreign companies in complex trials before Agrarian Courts and the Supreme Court of Justice, regarding ownership of land allegedly under agrarian regime.
Other Activities.
He has participated in Pro bono activities for “Pro-bono law Office of Universidad Panamericana”, as well as for the Santa Fe Community Center.
Academic Activities.
Mr. Aguilar was a professor on Constitutional Procedural Law at Universidad Panamericana. Likewise, he has been a professor along with Mr. Omar Cuellar in the lecture of Bankruptcy Proceedings and Forensic Practice in Constitutional Lawsuits (“Amparo”), at same university. He has given lectures as a substitute teacher of Mr. Omar Cuellar, of Constitutional Lawsuits (“Amparo II”) at the Universidad Anahuac del Norte and Commercial Law II (Negotiable Instruments and Credit Transactions) at Universidad Iberoamericana, Mexico City Campus. Additionally, he has taught Civil Procedure Law.
