The Labor Contract Law stipulates that an employer and an employee may agree upon only one probation period. In practice, there may be cases where the employee’s performance is unsatisfactory during probation period, employer wishes to extend the probationary period by negotiation with the employee for further appraisal so as to avoid the extra recruitment costs. The referring case in this issue will illustrate whether it is legal for employers to negotiate with an employee to extend the probation period.
