The Argentine Tax Authorities introduced a new Identification Code for foreign entities that make financial investments in Argentina.

The Argentine Tax Authorities (“ATA”) issued Resolution No. 3986/2017 (published in the Official Gazette on January 13, 2017), introducing a new identification code that will allow the operation of foreign entities that invest in Argentina but do not hold a tax identification number (“TIN”) or an identification code (“IC”).

This code, named Foreign Investments Code (“FIC”), is available for the financial entities described in the Financial Entities Law (Law No. 21,516) as well as financial agents registered in the National Securities Commission (“NSC”).  These entities must request the FIC before opening an account held by a foreign company.

The code may be requested through ATA’s website. The individual who requires the FIC will be considered “Manager holding a power of attorney” and will need to hold a Tax Identification Number (TIN) or a Worker´s Identification Code (WIC).

The individual must submit the following data and documentation:

  • Type of entity
  • Entity’s name
  • Entity´s country of origin and address
  • TIN held in the country of origin
  • Main activity
  • Complete name of the representatives.
  • TIN of the financial entity or agent registered in the NSC who acts as the entity´s representative for the creation of the FIC.
  • Digital file (in pdf) that proves the entity’s formation, in the original language and the translation into Spanish.

Once the request is approved, the code will be generated within 5 working days and notice will be given through ATA’s website.

The Resolution is effective since its publication in the Official Gazette. However, notice will be served in ATA´s website once the online service is available.

 

La Administración Federal de Ingresos Públicos Implementó una Nueva Clave de Identificación para entes colectivos del exterior que realicen inversiones financieras en Argentina.

La Administración Federal de Ingresos Públicos (“AFIP”) emitió la Resolución 3986/2017 (publicada en el Boletín Oficial el pasado 13 de enero de 2017) que implementa una nueva clave de idenitificación que permitirá operar en Argentina a aquellos entes que no posean CUIT ni CDI y quieran realizar inversiones en Argentina.

Esta clave, denominada Clave de Inversiones de Exterior (“CIE”) está habilitada para los entes financieros del país enumerados en la Ley 21.516 de Entidades Financieras y para agentes financieros registrados en la Comisión Nacional de Valores (CNV). Estos entes deberán solicitar dicha clave antes de abrir una cuenta cuyo titular sea una sociedad extranjera.

La misma puede solicitarse a través de la página web de AFIP. La persona humana que realice el trámite será considerado “Administrador de Relaciones Apoderado” y deberá poseer Clave Única de Identificación Tributaria (CUIT) o Código Único de Identificación Laboral (CUIL).

Al solicitar la CIE se deberán presentar los siguientes datos y documentación respaldatoria:

  • Tipo de entidad
  • Denominación de la entidad
  • País y domicilio de residencia de la entidad
  • Número de identificación fiscal en su país de residencia
  • Actividad principal
  • Apellido y nombres de los representantes
  • CUIT de la entidad financiera del país o agente registrado en la CNV, quien actúa como representante del ente en el exterior para la tramitación de la CIE.
  • Archivo digital (en pdf) que acredite la constitución de la entidad, en idioma original y su traducción al español.

En caso de aprobarse la solicitud, la clave se generará dentro de los 5 días hábiles y se comunicará a través del servicio online.

Por último, en cuanto a la entrada en vigencia, esta Resolución rige desde que se publicó en el Boletín Oficial. Sin embargo, se comunicará en el sitio web de AFIP cuando se encuentre disponible el servicio efectivamente online.
