A foreign flag vessel auctioned in Greece will have maritime liens claims judged under the law of the flag she flies.
Ranking will take place according to the Greek Code of Private Maritime Law. Privileged ranking will apply if a lien is recognised as Maritime under the law of the vessel’s flag at the time of ranking list drafting.
Piraeus One-Membered Court of Appeal Judgment No 120/2020, Judge: M. Papadogrigorakou, Attorneys at Law: G. Athanasiadis, G. Zouros, Maritime Law Review vol. 48, p. 41.
NOTE: One can see here a dual application of laws: A Lien is considered as Maritime, ie privileged, according to the flag law; however, ranking will be defined by the law of the auction jurisdiction.
