There have been some really interesting cases of enforcement for AI violations of privacy laws recently. Some having to do with the use of AI facial recognition, etc.
According to the Federal Trade Commission (FTC), “… (AI) companies that fail to abide by their privacy commitments to their users and customers, may be liable under the laws enforced by the FTC.” Furthermore, such companies “…must also abide by their commitments to customers regardless of how or where the commitment was made…”
Failure to disclose use of AI can potentially lead to costly lawsuits and/or FTC enforcement.
How to solve such potential legal liabilities?
Be TRANSPARENT
Abide by Privacy commitments.
Respect Privacy laws
If you use AI, get an AI Governance policy in place ASAP!
