HM Revenue Customs (HMRC) are more determined than ever to ‘claw back’ unpaid tax and to ensure all tax due is paid. As part of this process, it is increasingly common for individuals and businesses to receive visits and inspections from the Revenue. In some cases these visits can involve a Business Record Check, with an inspector asking to see your current records even before you submit a tax return.
If your affairs are in good order there should be little to worry about. It is however, the norm that when the Revenue make enquiries they will expect your professional adviser to explain how the computations have been prepared and how the amount of tax payable has been derived. As your trusted adviser we will also be best placed to support and advise you through the enquiry process and to deal with any specific issues that arise.
Needless to say this is likely to mean you incur fees for professional advice and time for which you had not budgeted. The target that HMRC set themselves to complete an enquiry is 18 months and therefore the professional fees can add up over this time and become substantial.
We have found that the most common reaction from clients is one of ‘we won’t be investigated’, but sadly this is not always the case and to an extent is increasingly less likely given that HMRC’s Business Plan targets an increase in revenue from tax enquiries over the coming years.
To ensure our clients are able to protect themselves from the unexpected professional fees associated with an investigation or enquiry then we are pleased to be able to offer our special fee protection service. The Service operates whereby on payment of an annual premium you receive up to £75,000 of cover in the event you receive an investigation, enquiry, review or intervention procedures.

Many of our clients choose to use our office as their company’s or limited liability partnership’s legal Registered Office. This is the address shown on the public register at Companies House and is the principal place to which Companies House and HM Revenue and Customs documents, forms and returns are sent and where official documents can be served.
In particular we find clients benefit from the simple cost effective solution we offer for those that do not want to use their own address as their Registered Office. Opting to use our address also provides increased privacy over and above using a more profile address or your home address. As your Registered Office we will receive correspondence on your behalf from Companies House and HM Revenue and Customs, with both organisations using our address as the only correspondence address.

The simple steps to setting up the Registered Office with King & King
If you are setting up a new company or limited liability partnership you can, as part the process of registering and forming the company, indicate that you wish to use our office as your Registered Office.
If you have an established Registered Office using either your business address or another address then the process of switching addresses is relatively simple where all that is required is the completion of a Companies House form AD01 Change of Registered Office Address. We will be only too pleased to supply you with the appropriate form or discuss with you the online filing process.
Once we either have the completed form or notification of the online filing, we set up your Registered Office facility and provide you with an invoice for an annual fee, which runs from 1st April to 31st March, or pro rata fee if set up sometime during the 12 month period.
We will also display the company or limited liability partnership name at the our address.
